These Terms of Use ("Terms") govern your access to and use of the Lossless Video Cutter Mac application and the website at losslessvideocutter.com (together, the "Service") provided by Nufrnd ("we", "us"). By downloading, installing, accessing, or using the Service, you agree to these Terms.

The Service

Lossless Video Cutter is a native macOS application for trimming and exporting video with stream copying and on-device analysis features. The website provides downloads, documentation, checkout links, and account management tools.

We may change, suspend, or discontinue any part of the Service at any time. Features labeled beta or experimental may change or be removed without notice.

Eligibility

You must be able to form a binding contract to use the Service. You are responsible for ensuring your use complies with applicable laws.

License to use the app

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Mac app on devices you control for personal or internal business purposes.

You may not:

• Reverse engineer, decompile, or attempt to extract source code except where law permits
• Remove or alter proprietary notices
• Share, resell, or sublicense license keys or activations beyond your plan limits
• Use the Service to build a competing product or to violate others' rights
• Interfere with the Service, our servers, or other users

Free, trial, and paid plans

Some features are free. Pro features require an active subscription or trial. Plan details and pricing are shown on the website and may change for new purchases.

Subscriptions are billed through Polar. Renewals, cancellations, taxes, and payment methods are handled under Polar's checkout and your subscription settings in the customer portal.

Free trials convert to paid subscriptions unless canceled before the trial ends. See the Refunds section below for eligibility and how to submit a request.

Refunds

You may request a refund within 24 hours of an initial purchase charge or a subscription renewal. Eligibility may also be limited by law, payment processor policy, or the terms of your plan.

To submit a request, use our refund request form. Include enough detail for us to match your account. We review eligible requests as quickly as we can but do not guarantee approval of every request.

Your content

You retain ownership of your videos, projects, and other content. You are solely responsible for the content you process with the Service and for having the rights needed to edit and export it.

Because processing happens on your Mac, you are responsible for backups, storage, and compliance with privacy laws that apply to your footage.

Third-party services

The Service integrates with third parties such as Polar (billing), Apple platforms (macOS frameworks, Sparkle updates), Google Analytics (website), and Cloudflare (hosting). Your use of those services may be subject to their terms and policies.

Updates

The app may download updates automatically or when you choose to update. Updates may be required for security, compatibility, or continued access to online features such as license validation.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that exports will be frame-accurate in every format, that detection features will find every match, or that the Service will be uninterrupted or error-free.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUFRND AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnity

You agree to defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required for legal or security reasons. Sections that by nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules. Exclusive jurisdiction for disputes will be in the state or federal courts located in Delaware, unless applicable law requires otherwise.

Changes

We may update these Terms from time to time. We will revise the "Last updated" date when we do. Continued use after changes means you accept the updated Terms.
